1. Acceptance of Terms

By accessing or using the mobile application (the "App") provided by Myrthyn Inc. ("we," "us," or "our"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you may not use the App.

2. Account Registration and Use

  • You may create an account using a display name/username and valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

  • You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

  • You may not use the App for any unlawful, infringing, or harmful purpose, including but not limited to violating intellectual property rights, distributing malware, or engaging in harassment.

 

3. Intellectual Property

  • All content, features, and functionality of the App (including but not limited to text, graphics, logos, and software) are the exclusive property of Myrthyn Inc. and are protected by copyright, trademark, and other intellectual property laws.

  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial work efficiency improvement purposes only. You may not copy, modify, distribute, or reverse-engineer the App or its components.

 

4. User-Generated Content

  • You retain ownership of any task lists, workflow plans, and other content you create or upload within the App ("User Content").

  • By submitting User Content, you grant Myrthyn Inc. a worldwide, non-exclusive, royalty-free license to use, store, and sync your User Content to provide and improve the App’s services.

  • You agree not to upload User Content that is infringing, defamatory, obscene, or otherwise violates applicable laws or third-party rights.

 

5. Disclaimers of Warranties

  • The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected. Your use of the App is at your sole risk.

 

6. Limitation of Liability

  • To the fullest extent permitted by law, Myrthyn Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, including but not limited to loss of data, profits, or business interruption.

  • This limitation applies regardless of the theory of liability, even if we have been advised of the possibility of such damages.

 

7. Termination

  • We may suspend or terminate your account and access to the App immediately, without prior notice or liability, if you breach these Terms and Conditions.

  • Upon termination, your right to use the App ceases immediately, and we may delete your account and associated User Content in accordance with our Privacy Policy.

 

8. Modifications to Terms

  • We reserve the right to modify or update these Terms and Conditions at any time. We will notify you of significant changes via in-App notifications or email.

  • Your continued use of the App after the effective date of the updated terms constitutes your acceptance of the changes.

 

9. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

  • Any disputes arising from these terms shall be resolved in the state or federal courts located in San Francisco, California.
